The company La Touche Originale, represented by Oscar Le Morvan, whose head office is located at 1 rue Lindebuckel, Schiltgheim, 67300, Alsace, France, email, telephone. In the general conditions of sale below, the company La Touche Originale is designated either by its name "La Touche Originale" or by "the seller" and the consumer is designated either by "customer" or "buyer". Placing an order via the La Touche Originale website or by any other means implies acceptance of these general terms and conditions of sale "the GTC". These GCS are only applicable to sales made between the seller and the consumer (any natural person acting for purposes that do not fall within the scope of their commercial, industrial, artisanal or liberal activity, according to the legal definition of the French Consumer Code), (B2C). Sales made between the seller and other companies are not covered by the GCS.

In particular, the GTCS provide for La Touche Originale's acceptance of the processing of nominative information relating to purchasers. Personal information relating to purchasers is protected in accordance with the law, and is not transferred, resold or lent to third parties. Contact details and personal information collected via our website are used exclusively to process orders.

Rates

Prices shown on the La Touche Originale website are in euros (EUR), all taxes included. All orders are honored at the price validated when the order is placed by the customer. Prices are subject to change without notice.

Payment

Orders are payable in cash via the various methods offered on the site when the order is placed.

Acceptance of T&Cs

Placing an order implies acceptance of these terms and conditions in their entirety.

Order processing

Products are available for sale as long as they are displayed on the site. However, La Touche Originale reserves the right to modify certain technical specifications without prior notice. The products presented (on the site or in our various documentations) do not constitute a legal offer but a non-contractual catalog whose prices and specifications may change at any time. To be valid, an order must be paid in full, in advance, using one of the various solutions offered (credit card or paypal). And correctly filled in the form displayed on the site, the buyer must provide his contact information / billing and shipping address, email and phone. La Touche Originale reserves the right not to execute an order if it proves to be manifestly erroneous, or a problem arises from the buyer's missing information. In this case, the seller will contact the customer to find the most appropriate solution. To this end, each order is subject to confirmation by the seller, and is deemed to have been accepted only on receipt of this confirmation e-mail.

Order cancellation

Orders placed via the site, by e-mail or by post can be cancelled until the order has been dispatched. Cancellation of the order will then be confirmed with the customer, who will be reimbursed for the amount paid.

Delivery times

Delivery times are given as an indication only and do not constitute a contractual commitment. Any change in the delivery time shall not constitute grounds for cancellation of the order, provided that the change in delivery time does not exceed 30 days from the original delivery time.

Delivery rates

Given the daily changes in our partners' transport offers, this table is subject to change without notice. For this reason, it is only indicative and has no contractual or binding value. In the event of a discrepancy with a rate proposed in a quotation or order, the rate in the quotation or order will prevail.

Reception

Each order is checked and packed with the greatest care. We advise you to check the condition of the package. If it is damaged, we strongly recommend that you refuse it.

Reservation of ownership

Products remain the property of La Touche Originale until full payment has been received.

Returns

Returns are possible for 15 days for standard products only (ready-to-install). Standard products are those that have not been specifically customized to the dimensions or characteristics supplied by the customer. In other words, any product that is not custom-made to the customer's precise specifications (dimensions, graphics, etc.) is considered standard. By extension, all products offered for sale on marketplaces such as Castorama, Leroy Merlin and La Redoute are deemed to be standard products, insofar as they are not designed on the basis of personalized instructions or measurements supplied by the customer. Except in the case of product defect, special orders (personalized products and made-to-measure formats) are not returnable. Custom-made wallpapers are manufactured with personalized dimensions (within the limits of manufacturing constraints), which prevents these products from being returned. In all cases, returns must be made in the original packaging and the products must be in good condition for the return to be validated. After checking the returned products and confirming their condition, the customer can choose between a refund (within 30 days of receipt of the product at La Touche Originale) or a credit note for the amount of the returned product. The latter allows the customer to place a new order of their choice.

Warranties and claims

Products sold by Touche Originale come with a 6-month warranty against defects. However, wallpapers, colors, chemicals and other materials used in our production may alter slightly over time, particularly as a result of UV radiation, significant temperature variations or excess humidity. There may also be occasional variations in shade from one production batch to another, in which case there is no right to replacement of any kind. In the event of a complaint, the customer must contact Touche Originale by e-mail or post, enclosing all relevant documents (photo of product, copy of delivery note, etc.). Claims against the carrier are made by the seller. Touche Originale will take the utmost care of your complaint and will reply as soon as possible. Claims for defects must be made within eight days of receipt of the products by the end customer.

All complaints must be made by e-mail (contact@latoucheoriginale.com). This e-mail must include all relevant information to help us deal with your request as quickly as possible (order/invoice number) and an explanation of the problem encountered. Telephone complaints cannot be taken into account unless they are accompanied by an e-mail to Customer Service as indicated above. In the absence of a complete file, the complaint will unfortunately be considered inadmissible. Wallpapers must be inspected by you or the installer you have appointed to carry out the work before installation. If you notice a defect in the product delivered, you must notify us immediately and do not begin installation. If there is an apparent defect on a delivered product and it is installed in spite of this, you are liable. In other words, no claim can be accepted once the product has been installed or fitted, even partially.

To be taken into account, a claim on a product with an apparent defect must reach us, in full, within 15 days of receipt of your order, otherwise the claim cannot be taken into account.

If you notice a defect after installation, either it is a perceptible defect for which you are responsible, or it is a problem related to the installation. In these cases, the return will not be possible.

Our wallpapers are produced using digital printing. It is possible to have a difference between the colors visualized on the screen (RGB) and the results of the colors on the wallpapers. If the customer wishes to have an example of the rendering of the wallpaper(s) chosen, La Touche Originale strongly recommends that the customer request a sample before placing the order.

All customers must read the installation instructions available on the product pages of the La Touche Originale website and included with orders.

Incorrect installation is the responsibility of the customer or the customer's installer, and La Touche Originale cannot accept any claims concerning installation issues.

Example of incorrect wallpaper installation:

• - wrong glue dosage ;
• - wallpaper instead of wall;
• - no substrate preparation ;
• - marouflage with an unsuitable object ;
• - mishandling wallpaper;
• - unsuitable cleaning.

This list is not exhaustive.
La Touche Originale supplies semi-finished wallpapers. La Touche Originale's guarantee ends as soon as the installation has been completed in full or in part.

If the complaint is made in good time and if, after verification, the existence of a defect is established and if the defect is not attributable to a defect in inspection, incorrect installation or cleaning, misuse or negligence on the part of the Customer, La Touche Originale will, at its discretion, replace the goods concerned free of charge or credit all or part of the amount invoiced for the goods, without La Touche Originale being liable for any compensation whatsoever.

Copyright

All the products offered on our site are original works created by La Touche Originale or by independent artists. Whatever the case, La Touche Originale holds the reproduction rights to the works concerned. Any reproduction of works without the agreement of the copyright holder would be a violation of his or her rights.

Respect for the operation of the website

In order not to disrupt the proper functioning of the La Touche Originale website, you agree not to use any tools, software or scripts in association with La Touche Originale. You must not take any action that intentionally blocks or slows down La Touche Originale, in particular by blocking, overwriting or modifying the content displayed or generated by the seller.

Damages and interest

In the event of the installation of products which are obviously not compliant (in terms of quality or references), the installation carried out by the customer cannot give rise to any claim for damages. The customer or the installation company is responsible for product installation.

Duration and modification of the GTC

These terms and conditions are valid for an unlimited period. We reserve the right to modify these terms and conditions at any time and without prior notice. The general terms and conditions of sale are those in force at the time the order is placed.

Election of jurisdiction

The Strasbourg court has sole jurisdiction to deal with any disputes arising from an order placed with La Touche Originale via our website or by any other means; and any dispute arising from the use of the La Touche Originale website, a more general problem relating to the La Touche Originale brand or claims arising from the rights of the works used in our ranges.
